How to Start a Business in Poland as a Foreigner (2025 Guide)

Jan magyer / 11 Mins

Poland is one of the easiest EU countries for foreigners who want to open a business. But if you don’t follow the right process from the start, you’ll face silent rejection, frozen bank accounts, or delayed residency.
This guide walks you through the legal steps to register a business in Poland as a foreigner. Whether you want to start a small company or use business as a path to residency in Poland, this is where you begin.

Why Foreigners Are Choosing Poland in 2025

Poland offers one of the lowest costs of entry for EU business setup. You don’t have to satisfy complex requirements, pass a language test or find a local partner.
Once your company is legally registered and active, you can apply for a Temporary Residence Card (TRC) tied to business activity. After five years, you’re eligible for permanent residency in Poland.
This includes 100% foreign ownership, a fast company setup, legal path to long-term EU stay, strong banking system and low corporate tax.
Here are the steps you need to follow to get started.

Step 1: Choose Your Legal Business Structure

As a foreigner, the Limited Liability Company (Sp. z o.o.) is the most accepted structure. It’s recognized by Polish authorities and works perfectly for residency applications.
Key facts:

  • No Polish citizenship or residency required
  • Requires at least one shareholder
  • Minimum share capital: 5,000 PLN (~€1,100)
  • Registered office address in Poland
Note: Avoid informal setups or fake businesses, Polish immigration checks activity before issuing your business TRC.

Step 2: Register the Company

Company registration is done via the National Court Register (KRS). You can register online or with our legal team on the ground.
What you’ll need:

  • Company name
  • Articles of association (we prepare this for you at Magyar)
  • Polish tax number (NIP)
  • REGON (statistical number)
  • Bank account
  • Proof of registered address
  • A sworn translator for official documents if you’re not fluent in Polish.

Step 3: Prove Real Business Activity

To qualify for residency through business in Poland, your company must show real operations. This means:
  • Registered with the Polish Tax Authority
  • Active bank account with visible business movement
  • Rental agreement for office or operations space
  • Invoice activity or service contracts
Note: Fake companies get flagged fast and your residency will be denied

Step 4: Apply for TRC (Temporary Residence Card) Based on Business

Once your business is live, apply for a TRC based on business activity. This is your legal ticket to stay long-term.
You’ll need:
  • Valid passport
  • Proof of business registration
  • Proof of activity (bank statements, contracts, rent, etc.)
  • Health insurance
  • Accommodation address
  • Clean background
Note: Processing time ranges from 60 to 90 days. If successful, you’ll receive a TRC that’s renewable and leads to permanent stay.
